Entenda:<\/span><\/p>\n<h3><b>Motivo do <\/b><b>desligamento<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">O <\/span><span style=\"font-weight: 400;\">desligamento do trabalhador<\/span><span style=\"font-weight: 400;\"> pode ocorrer de tr\u00eas formas principais, que podem influenciar na hora de processos <\/span><span style=\"font-weight: 400;\">como calcular rescis\u00e3o contratual<\/span><span style=\"font-weight: 400;\">:<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>&#8211;<\/strong> Pedido de demiss\u00e3o<\/span><span style=\"font-weight: 400;\">: por iniciativa pr\u00f3pria do <\/span><span style=\"font-weight: 400;\">colaborador,<\/span><span style=\"font-weight: 400;\"> que perde o direito de <\/span><span style=\"font-weight: 400;\">sacar o FGTS<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>&#8211;<\/strong> Dispensa com justa causa<\/span><span style=\"font-weight: 400;\">: por iniciativa da <\/span><span style=\"font-weight: 400;\">empresa<\/span><span style=\"font-weight: 400;\">, justificada por uma falha grave, que tamb\u00e9m impede o <\/span><span style=\"font-weight: 400;\">colaborador<\/span><span style=\"font-weight: 400;\"> de <\/span><span style=\"font-weight: 400;\">sacar seu FGTS<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>&#8211;<\/strong> Dispensa sem justa causa<\/span><span style=\"font-weight: 400;\">: por iniciativa da <\/span><span style=\"font-weight: 400;\">empresa<\/span><span style=\"font-weight: 400;\">, sem motivo espec\u00edfico, o que permite ao <\/span><span style=\"font-weight: 400;\">colaborador<\/span> <span style=\"font-weight: 400;\">sacar o FGTS<\/span><span style=\"font-weight: 400;\"> e ainda receber uma<\/span><span style=\"font-weight: 400;\"> multa<\/span><span style=\"font-weight: 400;\"> de 40%, devida pela<\/span><span style=\"font-weight: 400;\"> empresa<\/span><span style=\"font-weight: 400;\">, sobre o <\/span><span style=\"font-weight: 400;\">valor <\/span><span style=\"font-weight: 400;\">depositado no <\/span><span style=\"font-weight: 400;\">fundo<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Vale lembrar que o<\/span><span style=\"font-weight: 400;\"> Fundo de Garantia do Tempo de Servi\u00e7o<\/span><span style=\"font-weight: 400;\"> (<\/span><span style=\"font-weight: 400;\">FGTS<\/span><span style=\"font-weight: 400;\">) \u00e9 um<\/span><span style=\"font-weight: 400;\"> valor <\/span><span style=\"font-weight: 400;\">depositado mensalmente pelo <\/span><span style=\"font-weight: 400;\">empregador<\/span><span style=\"font-weight: 400;\"> para auxiliar os <\/span><span style=\"font-weight: 400;\">trabalhadores<\/span><span style=\"font-weight: 400;\"> que perdem o <\/span><span style=\"font-weight: 400;\">emprego<\/span><span style=\"font-weight: 400;\">. \u00c9 por isso que<\/span><span style=\"font-weight: 400;\"> pedido de demiss\u00e3o<\/span><span style=\"font-weight: 400;\"> e <\/span><span style=\"font-weight: 400;\">dispensa com justa causa<\/span><span style=\"font-weight: 400;\"> inviabilizam o <\/span><span style=\"font-weight: 400;\">saque do fundo<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h3><b>Aviso pr\u00e9vio<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Aviso pr\u00e9vio<\/span><span style=\"font-weight: 400;\"> \u00e9 a comunica\u00e7\u00e3o antecipada da <\/span><span style=\"font-weight: 400;\">rescis\u00e3o contratual<\/span><span style=\"font-weight: 400;\"> pelo <\/span><span style=\"font-weight: 400;\">empregador<\/span><span style=\"font-weight: 400;\"> ao <\/span><span style=\"font-weight: 400;\">empregado<\/span><span style=\"font-weight: 400;\">, ou vice-versa.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A partir desse aviso, cumpre-se um <\/span><span style=\"font-weight: 400;\">per\u00edodo de trabalho<\/span><span style=\"font-weight: 400;\"> que dura de 30 a 90 dias, de acordo com o<\/span><span style=\"font-weight: 400;\"> tempo de servi\u00e7o<\/span><span style=\"font-weight: 400;\"> (para <\/span><span style=\"font-weight: 400;\">demiss\u00f5es sem justa causa<\/span><span style=\"font-weight: 400;\">, o <\/span><span style=\"font-weight: 400;\">trabalhador<\/span><span style=\"font-weight: 400;\"> ganha 3 dias adicionais por cada ano trabalhado, al\u00e9m do m\u00ednimo de 30 dias).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nos casos de <\/span><span style=\"font-weight: 400;\">dispensa com justa causa<\/span><span style=\"font-weight: 400;\">, o <\/span><span style=\"font-weight: 400;\">colaborador<\/span><span style=\"font-weight: 400;\"> perde este <\/span><span style=\"font-weight: 400;\">benef\u00edcio<\/span><span style=\"font-weight: 400;\">. J\u00e1 no <\/span><span style=\"font-weight: 400;\">pedido de demiss\u00e3o<\/span><span style=\"font-weight: 400;\"> ou <\/span><span style=\"font-weight: 400;\">dispensa sem justa causa<\/span><span style=\"font-weight: 400;\">, a <\/span><span style=\"font-weight: 400;\">empresa<\/span><span style=\"font-weight: 400;\"> deve optar por uma das op\u00e7\u00f5es:<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>&#8211;<\/strong> Aviso pr\u00e9vio trabalhado<\/span><span style=\"font-weight: 400;\">: o <\/span><span style=\"font-weight: 400;\">trabalhador<\/span><span style=\"font-weight: 400;\"> cumpre o per\u00edodo exercendo suas atividades.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>&#8211;<\/strong> Aviso pr\u00e9vio indenizado<\/span><span style=\"font-weight: 400;\">: o <\/span><span style=\"font-weight: 400;\">trabalhador<\/span><span style=\"font-weight: 400;\"> \u00e9 dispensado no momento da <\/span><span style=\"font-weight: 400;\">demiss\u00e3o<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Em ambos os casos, o <\/span><span style=\"font-weight: 400;\">empregado<\/span><span style=\"font-weight: 400;\"> recebe seus <\/span><span style=\"font-weight: 400;\">vencimentos<\/span><span style=\"font-weight: 400;\"> normalmente, e o <\/span><span style=\"font-weight: 400;\">aviso pr\u00e9vio<\/span><span style=\"font-weight: 400;\"> \u00e9 considerado no <\/span><span style=\"font-weight: 400;\">c\u00e1lculo da rescis\u00e3o<\/span><span style=\"font-weight: 400;\"> como <\/span><span style=\"font-weight: 400;\">tempo trabalhado<\/span><span style=\"font-weight: 400;\">, ou seja, comp\u00f5e a contagem de<\/span><span style=\"font-weight: 400;\"> f\u00e9rias<\/span><span style=\"font-weight: 400;\"> e <\/span><span style=\"font-weight: 400;\">13\u00ba sal\u00e1rio<\/span><span style=\"font-weight: 400;\">, por exemplo.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Por\u00e9m, se foi o <\/span><span style=\"font-weight: 400;\">funcion\u00e1rio <\/span><span style=\"font-weight: 400;\">que pediu <\/span><span style=\"font-weight: 400;\">demiss\u00e3o<\/span><span style=\"font-weight: 400;\"> e n\u00e3o quis cumprir o <\/span><span style=\"font-weight: 400;\">aviso pr\u00e9vio<\/span><span style=\"font-weight: 400;\">, a <\/span><span style=\"font-weight: 400;\">empresa <\/span><span style=\"font-weight: 400;\">n\u00e3o precisa incluir esse <\/span><span style=\"font-weight: 400;\">valor <\/span><span style=\"font-weight: 400;\">no<\/span><span style=\"font-weight: 400;\"> c\u00e1lculo<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h3><b>Saldo do sal\u00e1rio<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">O <\/span><span style=\"font-weight: 400;\">saldo do sal\u00e1rio<\/span><span style=\"font-weight: 400;\"> refere-se \u00e0 <\/span><span style=\"font-weight: 400;\">remunera\u00e7\u00e3o<\/span><span style=\"font-weight: 400;\"> dos <\/span><span style=\"font-weight: 400;\">dias trabalhados<\/span><span style=\"font-weight: 400;\"> no m\u00eas da <\/span><span style=\"font-weight: 400;\">rescis\u00e3o contratual<\/span><span style=\"font-weight: 400;\">, desde o <\/span><span style=\"font-weight: 400;\">pagamento<\/span><span style=\"font-weight: 400;\"> do \u00faltimo <\/span><span style=\"font-weight: 400;\">sal\u00e1rio<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Para <\/span><span style=\"font-weight: 400;\">calcular<\/span><span style=\"font-weight: 400;\"> esse <\/span><span style=\"font-weight: 400;\">valor<\/span><span style=\"font-weight: 400;\">, voc\u00ea deve dividir o <\/span><span style=\"font-weight: 400;\">sal\u00e1rio<\/span><span style=\"font-weight: 400;\"> pelo n\u00famero de dias do m\u00eas da <\/span><span style=\"font-weight: 400;\">rescis\u00e3o<\/span><span style=\"font-weight: 400;\">. O resultado, ent\u00e3o, deve ser multiplicado pelo n\u00famero de <\/span><span style=\"font-weight: 400;\">dias trabalhados<\/span><span style=\"font-weight: 400;\"> naquele m\u00eas.<\/span><\/p>\n<h3><b>13\u00ba sal\u00e1rio<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">O<\/span><span style=\"font-weight: 400;\"> trabalhador<\/span><span style=\"font-weight: 400;\"> tamb\u00e9m tem direito a receber o <\/span><span style=\"font-weight: 400;\">13\u00ba sal\u00e1rio<\/span><span style=\"font-weight: 400;\"> proporcionalmente aos meses trabalhados at\u00e9 o momento da <\/span><span style=\"font-weight: 400;\">rescis\u00e3o.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Para fazer esse<\/span><span style=\"font-weight: 400;\"> c\u00e1lculo<\/span><span style=\"font-weight: 400;\">, o <\/span><span style=\"font-weight: 400;\">valor do 13\u00ba sal\u00e1rio<\/span><span style=\"font-weight: 400;\"> deve ser dividido por 12. O resultado, ent\u00e3o, ser\u00e1 multiplicado pela quantidade de meses trabalhados desde janeiro. No \u00faltimo m\u00eas, se o <\/span><span style=\"font-weight: 400;\">colaborador<\/span><span style=\"font-weight: 400;\"> trabalhar mais de 15 dias (a contar do dia da sua <\/span><span style=\"font-weight: 400;\">admiss\u00e3o<\/span><span style=\"font-weight: 400;\">), o m\u00eas cheio \u00e9 considerado no<\/span><span style=\"font-weight: 400;\"> c\u00e1lculo<\/span><span style=\"font-weight: 400;\">; se trabalhar menos de 15 dias, o m\u00eas \u00e9 descartado.<\/span><\/p>\n<h3><b>F\u00e9rias<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">F\u00e9rias<\/span><span style=\"font-weight: 400;\"> tamb\u00e9m s\u00e3o um <\/span><span style=\"font-weight: 400;\">direito do trabalhador <\/span><span style=\"font-weight: 400;\">e devem constar no <\/span><span style=\"font-weight: 400;\">c\u00e1lculo da rescis\u00e3o<\/span><span style=\"font-weight: 400;\">. Se ele tiver<\/span><span style=\"font-weight: 400;\"> f\u00e9rias vencidas<\/span><span style=\"font-weight: 400;\">, o <\/span><span style=\"font-weight: 400;\">valor<\/span><span style=\"font-weight: 400;\"> de um <\/span><span style=\"font-weight: 400;\">sal\u00e1rio<\/span><span style=\"font-weight: 400;\"> mais um ter\u00e7o deve entrar na <\/span><span style=\"font-weight: 400;\">conta<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Al\u00e9m disso, ele deve<\/span><span style=\"font-weight: 400;\"> receber<\/span><span style=\"font-weight: 400;\"> tamb\u00e9m pelas <\/span><span style=\"font-weight: 400;\">f\u00e9rias proporcionais<\/span><span style=\"font-weight: 400;\">, ou seja, que ainda n\u00e3o foram gozadas. Para esse<\/span><span style=\"font-weight: 400;\"> c\u00e1lculo<\/span><span style=\"font-weight: 400;\">, usa-se a mesma l\u00f3gica do <\/span><span style=\"font-weight: 400;\">13\u00ba sal\u00e1rio <\/span><span style=\"font-weight: 400;\">(meses trabalhados) e a regra dos 15 dias.<\/span><\/p>\n<h3><b>Horas extras<\/b><b> e<\/b><b> adicionais<\/b><\/h3>\n<p><a href=\"https:\/\/www.pontotel.com.br\/como-calcular-hora-extra\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">No<\/span><\/a> <span style=\"font-weight: 400;\">acerto trabalhista<\/span><span style=\"font-weight: 400;\"> tamb\u00e9m entram as <\/span><a href=\"https:\/\/www.pontotel.com.br\/como-calcular-hora-extra\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">horas extra<\/span><span style=\"font-weight: 400;\">s<\/span><\/a> <span style=\"font-weight: 400;\">trabalhadas e n\u00e3o <\/span><span style=\"font-weight: 400;\">remuneradas<\/span><span style=\"font-weight: 400;\"> ou n\u00e3o usufru\u00eddas, caso o<\/span><span style=\"font-weight: 400;\"> trabalhador<\/span><span style=\"font-weight: 400;\"> fa\u00e7a jus a elas. Para definir o <\/span><span style=\"font-weight: 400;\">valor da hora extra<\/span><span style=\"font-weight: 400;\">, primeiramente voc\u00ea deve dividir o <\/span><span style=\"font-weight: 400;\">sal\u00e1rio<\/span><span style=\"font-weight: 400;\"> por 220 (n\u00famero de <\/span><span style=\"font-weight: 400;\">horas trabalhadas<\/span><span style=\"font-weight: 400;\"> durante um m\u00eas, de acordo com a <\/span><span style=\"font-weight: 400;\">CLT<\/span><span style=\"font-weight: 400;\">).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Se o<\/span><span style=\"font-weight: 400;\"> trabalhador<\/span><span style=\"font-weight: 400;\"> tiver <\/span><span style=\"font-weight: 400;\">horas extras<\/span><span style=\"font-weight: 400;\"> em hor\u00e1rio comercial, ele deve receber pelo menos 50% a mais do que o<\/span><span style=\"font-weight: 400;\"> valor <\/span><span style=\"font-weight: 400;\">resultante dessa divis\u00e3o. Para adicional noturno (entre 22h e 5h), acrescenta-se ainda 20%. No caso de domingos e feriados, o <\/span><span style=\"font-weight: 400;\">valor da hora extra<\/span><span style=\"font-weight: 400;\"> dobra.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pronto, agora voc\u00ea j\u00e1 sabe <\/span><span style=\"font-weight: 400;\">como calcular rescis\u00e3o contratual<\/span><span style=\"font-weight: 400;\"> e as principais vari\u00e1veis do processo.
